On April 26, 2025 at 11:31 a.m., 911 dispatchers received a call for the report of a customer trouble involving a physical altercation between an unruly individual (suspect) and a gas station employee at the Speedy Trac gas station/convenience store, located at 4011 W. Henrietta Rd., Henrietta. The physical altercation escalated between the suspect and the store owner, with the suspect drawing a revolver and firing two rounds inside the store. As a result, an innocent bystander, a nine year old boy waiting with his father to cash out, was struck once in the upper chest by one of the rounds. The store owner was able to disarm the suspect and detain him, with assistance from other employees and customers. 

Upon arrival, deputies secured the scene and the child was transported immediately to a local hospital for treatment of his injuries. As of late Saturday afternoon (04.26.25) the boy was listed in stable condition and expected to make a full recovery. Deputies also recovered the revolver, and detained the suspect, Ruben Smith, 35, of Henrietta. 

Smith was arrested and charged with the following:

  •     2 counts of Assault in the 2nd degree (Class-D Felony)
  •     2 counts of Criminal Possession of a Weapon in the 2nd degree (Class-C Felony)

Smith was arraigned in CAP Court and remanded to the Monroe County Jail held no bail/no release. He is a predicate felon known to law enforcement, with multiple prior arrests. He did sustain minor injuries during the incident, was transported to a local hospital, treated and released to the custody of MCSO.

The investigation is ongoing. Additional charges may be lodged pending presentation to a grand jury.
