MCSO’s immigration practice remains unchanged:
- MCSO follows the law and Constitution
- MCSO cooperates with federal law enforcement partners
- MCSO does not stop or inquire based solely upon immigration status
- Victims and witnesses of crimes must feel safe reporting offenses without fear. Deputies do not inquire about immigration status when individuals report crimes or seek assistance.
Federal Criminal Arrest Warrants:
If a federal court arrest warrant for criminal charges is issued by a magistrate or judge, MCSO may:
- Assist federal agencies
- Detain the individual
- Have Police Bureau deputies serve the federal criminal arrest warrant
Federal Civil Detainers:
- MCSO does not have the authority to detain individuals on a federal civil detainer or administrative arrest warrant
- Under New York State law, MCSO cannot detain individuals solely for a civil immigration violation
