THE MONROE COUNTY SHERIFF’S OFFICE AND MONROE COUNTY HEROIN TASK FORCE MAKE ARRESTS IN FATAL DRUG OVERDOSE INVESTIGATION

(Gates, NY) July 7, 2021 - On Wednesday, June 2, 2021, at 3:49 p.m., Monroe County Sheriff’s deputies responded to a medical assist on Rt. 490 West near Rt. 531 in the Town of Gates for the report of an unresponsive driver and passenger inside of a vehicle on the side of the road.

A NYSDOT Help Truck driver initially observed the vehicle stopped on the side of the road with its flashers on, indicating the occupants needed assistance. When the NYSDOT driver approached the vehicle, he observed the male driver of the vehicle and the female passenger both unconscious. When the NYSDOT driver went back to his truck to notify dispatch, the driver of the stopped vehicle became conscious and removed the passenger from the vehicle, placing her onto the ground.

Upon arrival, MCSO deputies observed the passenger on the ground being treated by EMS for an apparent drug overdose. The passenger’s condition did not improve and she was subsequently transported by EMS to Unity Hospital. MCSO was later informed the passenger was pronounced deceased at the hospital.

Deputies and investigators with the Monroe County Heroin Task Force became involved in the investigation. Deputies arrested and charged the driver, Elliot Gile, 24, Batavia, with DWI. A Drug Recognition Expert Assessment warranted additional charges of Driving While Ability Impaired by Drugs, and other trafficrelated offenses. Mr. Gile was issued an appearance ticket.

A follow up investigation into the source of the drugs that led to the fatal overdose, included a traffic stop involving another vehicle at 799 N. Clinton Ave., Rochester. On June 3, 2021 at 12:15 a.m., the Monroe County Heroin Task Force, along with MCSO patrol deputies and investigators, arrested Jacob Daniel Pimentel-Hernandez, 21, Rochester. Deputies charged Mr. Pimentel-Hernandez with Criminal Sale of a Controlled Substance, 3rd degree (Class B – Felony), two counts of Criminal Possession of a Controlled Substance, 3rd degree, (Class B-Felony), Criminal Possession of a Weapon, 2nd, (Class C-Felony), and two counts of Criminally Using Drug Paraphernalia, 2nd (Class A-Misdemeanor). The investigation continued and a Federal Complaint alleging the suspect, Pimentel-Hernandez, violated US Code under Title 21 (Possession with Intent to Distribute and Distribution of Fentanyl) and Title 18 (Possession of a Firearm in Furtherance of a Drug Trafficking Crime) was signed by a Federal Magistrate. The federal charges were lodged at the Monroe County Jail (MCJ) where Pimentel-Hernandez is being held.

  • Two counts (2) Criminally Using Drug Paraphernalia, 2nd (Class A-Misdemeanor)

Federal Charges:

  • Violated US Code under Title 21 (Possession with Intent to Distribute and Distribution of Fentanyl)
  • Violated US Code under Title 18 (Possession of a Firearm in Furtherance of a Drug Trafficking Crime)
